That is why I sent the email to a lawyer. It is possible that the cases are different (or not). If it is the same situation, then I would expect that it will be dismissed for that reason. Even though it's truly libel, not a nuisance suit, I don't think he should be suing in New York. THe libel laws in Europe and the United States are different. Also, the rules for "standing" (ability to sue as a damaged party) are different. It may be that the lawyer could have a better case in the New York court rather than in Sweden. You would have to check with an expert in libel law in both places to determine that. Not necessarily.
